Terms of Service

Welcome to OUSSHOOP (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our Shopify store (the “Store”), including the purchase of our earrings, rings, and other jewelry products (the “Products”), and any interactions with our services. By accessing, browsing, or using our Store, or purchasing any Products, you (“you” or “Customer”) agree to be bound by these Terms, as well as our Privacy Policy, Shipping & Returns Policy, and any other policies referenced herein or posted on our Store. If you do not agree to these Terms, please do not use our Store or purchase our Products.
These Terms comply with applicable United States laws and regulations, as well as Shopify’s platform terms of service, to ensure a fair and transparent relationship between OUSSHOOP and our Customers.

1. Eligibility & Account Usage

To use our Store and purchase Products, you must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding contract. If you are using our Store on behalf of a business, you represent and warrant that you have the authority to bind that business to these Terms.

If you create an account on our Store, you are responsible for maintaining the confidentiality of your account credentials (username, password) and for all activities conducted under your account. You agree to notify us immediately at service@ousshoop.com if you suspect any unauthorized access to or use of your account. We are not liable for any loss or damage resulting from your failure to protect your account credentials.

You agree to use your account and our Store only for legitimate purposes, and you will not engage in any activity that violates these Terms, applicable laws, or Shopify’s Acceptable Use Policy.

2. Product Information & Pricing

We strive to provide accurate and up-to-date information about our Products, including descriptions, images, sizes, materials, and pricing. However, we do not guarantee that all Product information is error-free, complete, or current. Images of Products are for illustrative purposes only and may vary slightly from the actual Product (e.g., color, finish) due to lighting, screen resolution, or manufacturing variations.

Pricing for Products is displayed in U.S. Dollars (USD) and does not include shipping costs, taxes, or other fees, which will be added at checkout. We reserve the right to change Product prices at any time without prior notice. We also reserve the right to correct pricing errors, even after an order has been placed, if the error is significant and brought to our attention. If a pricing error is identified and the correct price is higher than the price you were charged, we will contact you to confirm whether you wish to proceed with the order at the correct price or cancel the order for a full refund.

We reserve the right to discontinue any Product at any time, without prior notice. If a Product you have ordered is discontinued or out of stock, we will contact you to offer a refund, exchange, or alternative Product (if available).

3. Orders & Payment

3.1 Order Placement & Acceptance

When you place an order on our Store, you are making a binding offer to purchase the Products specified in your order. We reserve the right to accept or reject your order at our discretion, for any reason (e.g., out-of-stock Products, pricing errors, suspicious activity). If we reject your order, we will notify you via email (at the email address you provided) and issue a full refund if you have already paid.

Once we accept your order, a binding contract is formed between you and OUSSHOOP. We will send you an order confirmation email with details of your order (order number, Products, total amount, shipping address) shortly after acceptance. It is your responsibility to review the order confirmation and notify us immediately at service@ousshoop.com if there are any errors.

3.2 Payment Terms

All payments must be made in full at the time of order placement, using the payment methods accepted on our Store (e.g., credit card, debit card, Shopify Payments, PayPal). By providing payment information, you represent and warrant that you are authorized to use the payment method and that the information you provide is accurate.

We do not store full payment details; all payment processing is handled by trusted third-party payment processors (e.g., Shopify Payments), which comply with industry security standards to protect your payment information. We are not liable for any unauthorized charges or fraudulent activity related to your payment method, provided you notify us and your payment provider promptly of any suspicious activity.

4. Shipping & Delivery

Shipping and delivery terms are governed by our separate Shipping & Returns Policy, which is incorporated herein by reference. By placing an order, you agree to comply with the terms of our Shipping & Returns Policy, including those related to shipping times, tracking, delivery addresses, and shipping costs.

We are not responsible for delays, lost packages, or damaged Products caused by third-party shipping carriers, incorrect or incomplete shipping addresses provided by you, or unforeseen circumstances (e.g., weather, natural disasters, customs delays). You are responsible for providing a correct and complete shipping address, and we recommend double-checking your address before placing your order.

5. Returns & Exchanges

Returns and exchanges are governed by our separate Shipping & Returns Policy, which is incorporated herein by reference. By purchasing our Products, you agree to comply with the terms of our Shipping & Returns Policy, including eligibility requirements, return procedures, and refund timelines.

For hygiene reasons, earrings are not eligible for return or exchange unless they arrive damaged or defective. All returned Products must be unused, unworn, and in their original packaging with all tags attached to be eligible for a refund or exchange. Return shipping costs are the responsibility of the Customer, unless the Product is defective or we sent the wrong item.

6. Intellectual Property

All intellectual property rights in and to our Store, including but not limited to trademarks, logos, Product designs, images, text, and software, are owned by OUSSHOOP or our licensors. You may not copy, reproduce, distribute, modify, display, or use any of this intellectual property without our prior written permission.

By submitting any content (e.g., reviews, photos, feedback) to our Store, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display that content for marketing, promotional, and other business purposes, without additional compensation to you. You represent and warrant that you own the content or have the right to grant this license, and that the content does not infringe on any third-party intellectual property rights.

7. User Conduct

You agree to use our Store in a manner that is lawful, respectful, and compliant with these Terms. You will not:

- Engage in any fraudulent, deceptive, or misleading activity (e.g., using fake information to place orders, attempting to obtain Products without payment).

- Violate any applicable laws, regulations, or third-party rights (e.g., intellectual property rights, privacy rights).

- Upload or transmit any harmful, offensive, or inappropriate content (e.g., malware, viruses, hate speech, explicit material).

- Interfere with the operation of our Store or Shopify’s platform, or attempt to access unauthorized areas of our Store or systems.

- Resell or distribute our Products for commercial purposes without our prior written permission.

We reserve the right to terminate your access to our Store, cancel your orders, and pursue legal action if you violate these terms of conduct.

8. Limitation of Liability

To the maximum extent permitted by applicable law, OUSSHOOP shall not be liable for any direct, indirect, incidental, consequential, or special damages (including but not limited to lost profits, lost data, or damage to personal property) arising out of or in connection with your use of our Store, purchase of Products, or these Terms. This limitation applies regardless of whether the damages are caused by negligence, breach of contract, or any other legal theory.

Our total liability to you for any claim arising out of or in connection with these Terms or your use of our Store shall not exceed the total amount you paid for the Products giving rise to the claim. This limitation does not apply to damages caused by our gross negligence, willful misconduct, or failure to comply with applicable laws, or to damages for personal injury or property damage caused by defective Products.

We are not liable for any delays or failures in performance caused by circumstances beyond our reasonable control (e.g., weather, natural disasters, labor strikes, supply chain disruptions, or third-party service outages).

9. Indemnification

You agree to indemnify, defend, and hold harmless OUSSHOOP, our employees, officers, directors, and licensors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or in connection with: (i) your use of our Store or purchase of Products; (ii) your violation of these Terms or applicable laws; (iii) your violation of any third-party rights (e.g., intellectual property rights, privacy rights); or (iv) any content you submit to our Store.

10. Modifications to These Terms

We reserve the right to update, modify, or revise these Terms at any time, at our sole discretion. When we make significant changes, we will update the “Effective Date” at the top of this page and notify you by posting a notice on our Store or sending you an email (if you have provided your email address). Your continued use of our Store or purchase of Products after the modified Terms are posted constitutes your acceptance of the changes.

We encourage you to review these Terms periodically to stay informed about any updates. The latest version of these Terms will always be posted on our Store and will govern our relationship with you.
